SALES CONTRACT

This sales contract is executed on the                                 (date) between above named Breeder (herein known as seller) and________________________________________ (herein known as buyers), concerning the following dog.

It is hereby agreed to, by and between seller and buyer that:

01. Seller offers a 48 hour veterinarian check on this dog. If within that time buyer is dissatisfied with dog or buyers veterinarian finds dog to be in ill health, buyer has the right to return dog to seller for full refund of the above stated purchase price. After this time buyer shall assume full responsibility for the health, appearance, temperament and training of the dog. Sellers shall no longer assume any responsibility for the future outcome of the dogs health, appearance or temperament.

02. Seller guarantees above described dog is a purebred ROTTWEILER, registerable with the CKC (Canadian Kennel Club), and that the correct CKC registration papers have or will be given to the buyer. In case of PET-quality purchase, CKC papers will be handed over as soon as dog is rendered sterile and seller has written proof from vet who performed the procedure. Until this point registration papers will stay in breeders file. Be it known however that although this dog is CKC registerable and is bred from pure quality blood lines, this does not in any way guarantee, that said dog will complete its breed championship.

03. Buyer agrees, that at two years of age the dog will be X-rayed for evaluation of dogs hips and that the X-rays will be sent to the ORTHOPAEDIC FOUNDATION for animals (OFA). A copy of this evaluation must be sent to seller. (applies only to show-breeding quality).

04. GUARANTEES SHOW/BREED: If dog does not certify as being free of hip dysplasia by the OFA (seller will need proof of cause, see clause 06) seller agrees to refund difference from breed to pet price, or will replace dog with puppy from the next available litter (6-12 month waiting period could be expected) for no additional cost. This offer will become effective only after buyer shows proof to sellers that dog has been rendered sterile (applicable for refund of difference only) or written proof of euthanasia (applicable for replacement only). NOTE: replacement dog shall have the same guarantee as listed herein.

PET: If dog show severe hip dysplasia (seller will need proof of cause, see clause 06) at age 5 month to two years and buyers veterinarian recommends euthanasia of said dog, seller agrees to replace dog with puppy from next available litter (6-12 month waiting period could be expected) for no additional cost. Offer effective only upon receipt of written certification of euthanasia of said dog,. NOTE: replacement dog shall have same guarantee as listed herein.

05. If SHOW/BREED DOG UPON maturity has any disqualifying faults as set forth in the CKC standards for ROTTWEILERS one of the following options will become available to buyer:

A. Seller will take back said dog and replace with a puppy from next available litter (6-12 month waiting period could be expected) for no extra charge.

B. Seller will reimburse buyer with the difference between show and pet quality upon receipt of sterilization proof from buyers vet.

C. Buyer may purchase a new puppy (different sire & dam ) from seller for the pet-quality price and keep said dog upon receipt of sterilization proof from buyers vet.

Also included in guarantee will be any problem concerning skin, eyes, or any serious disease which could occur, as long as it can be 100 % proven, that it is of hereditary nature or caused due to a .

06. In case of a health problem of any kind, where buyer or buyers vet believes, it is of hereditary nature or caused by birth defect, seller will need written statements, test results etc. from buyers vet and will reserve the right, that dog can be examined by a vet of sellers choice and all documentations have to be made available to seller and/or sellers veterinarian. In case of hip dysplasia seller will need the x-rays from dogs hips and seller has the right to have those send to a vet or the university of Guelph or Saskatchewan for further investigation (if necessary). If it is proven fact that dysplasia was not caused environmentally (too much activity as puppy, climbing stairs, jumping, being pressured on rear end, booting etc.) which can be deducted from x-rays, than full guaranty will apply.

ALL GUARANTEES ABOVE  WILL APPLY UP UNTIL THE DOG REACHED THE  AGE OF 2 (two)  YEARS SELLER WILL NOT REFUND ANY EXPENSES OCCURRING BY VETERINARIANS REGARDING ANY HEALTH PROBLEMS, IF BUYER DECIDES TO HAVE SAID DOG TREATED FOR ANY CONDITIONS MENTIONED ABOVE

          IT IS BUYERS FREE CHOICE TO PAY EXPENSES AND SELLER WILL NOT BE RESPONSIBLE.

SELLER WILL ONLY REPLACE DOG IF SEVERE HEALTH CONDITIONS ARE FOUND, BUT NOT REFUND MONEY UNLESS SELLER CAN NOT PROVIDE ANOTHER DOG WITHIN ONE YEAR. SELLER ALSO HIGHLY SUGGESTS TO KEEP THE DOG ON PET PLAN INSURANCE WHICH WILL LOWER VET BILLS AND PROTECT EVRYONES INTEREST.

Replacement stand for an actuall puppy not the money value..we do not refund money
In all unusual or  difficult health cases which might occure seller has to be informed and kept updated

07. If buyer breeds dog before the age of two years and /or before certification from the OFA that the dog has normal good hips, any and all guarantees offered herein by seller to buyer shall become null and void.

08. Buyer agrees that he or she will never breed said dog to any uncertified OFA hipped animal. Buyer further agrees that said dog will only be bred to another purebred registered ROTTWEILER with no disqualifying faults as listed in the standards for the breed.

09. Buyer agrees that if at any time he or she decides to sell said dog, sellers will be contacted and given the first right of refusal on dog. It will be sellers decision, if dog shall be sold to person recommended by buyer and same contract will apply with all regulations mentioned herein. Seller also has option to take back said dog in consignment until a proper new home is found, suitable to the dog's temperament and condition.

10. If Seller is informed, that dog has been bred before the the age of two years and/or to unqualified mate, buyer agrees to pay a penalty fee of $ 2.000,— (two thousand)  immediately, due to the fact that sellers will not agree to certain breeding methods and considers this an act of negligence and failure to keep this contract.

Further seller will also take the equivalent amount of a pick puppy or of a stud fee which originally was a part of the purchase price, instead of a pup or a breeding to male, seller will not consider any further future dealings in that case. If payment is not received within a set period of time buyer is advised, that seller will take any legal step necessarily and this contract will be used as proof.

11. In case of not enough puppies-males-females in this litter, buyer agrees to wait for next upcoming litters, but not longer than a year from contract date, except otherwise agreed....... YES ____NO _____ .Down payment will be held till then.

12. Also buyer has to inform him/herself about the dog bylaws in their community and should agree to keep - train - and raise dog by those laws. If it should come to sellers attention, ( proof by neighbours, animal shelter, police or any other sources) that the dog is kept in irresponsible manner as - neglected , running loose through neighbourhood, physically abused, or if dog is used in a manner representing a weapon as a threat to society, seller will reserve the right to repossess the dog , if necessary with the help of legal authority , no refunds will be given.

13. Buyer understands that the tails on the pups might be NOT docked as to new regulations and laws which will be in effect in the near future.  Buyer agrees to purchase the pup either WITH or WITHOUT tail.

Buyer has 3 days to cancel undersigned contract and will receive full down payment minus $ 30,—(thirty) administration fee, any time after $ 250,— (two hundred fifty) will be deducted from original down payment, considering future advertising fee's , administration expenses , etc. which will occur in order to line up another suitable buyer. Any time after the dog is purchased and leaving the kennel , no money refund will be given, but dog could be taken in consignment, if buyer agrees.

This sales contract has been read by both the undersigned seller's) and the undersigned buyer's) and their signatures affixed her under attest to their complete understanding and agreement of the contents herein. Contract only in effect upon receipt of signed copy and down payment to breeder (seller).
